Terms of Service (TOS)

1. PRIOR TO COMMISSIONING

1.1 All necessary information to complete the commission (commission specifics), including deadline information must be provided. If no deadline is agreed upon before payment, it will be assumed that there is no deadline.
For rush commissions (completion in less than 2 weeks) for all styles except sketch or simple chibi, a rush fee will be included in the total commission price.
The minimum time frame for all commissions except sketch and simple chibi is 5 days

1.2 If the commissioner wishes to keep the final commission private, meaning no posting of the final commission on my portfolio and any of my social media websites, a 35% privacy fee of the total commission will be added.

1.3 Prices are in USD but payment can be made via some other currencies
Client will pay the USD equivalent.

1.4 Payment process:
1.4.1 The client must pay upfront or 50% before sketch and 50% at the halfway point (which I will notify you of when it is reached)
1.4.2 Both will be paid via PayPal invoice.
1.4.3 Anything $30 and under needs to be paid fully upfront.
1.4.4 Any amount of money directly sent to me without an invoice will be counted as a tip.

1.5 Turnaround times will depend on complexity and personal circumstances.
This turnaround time is usually a minimum of 5 days maximum of 1.5 months.

1.6 Artist reserves the right to decline any commission request for any reason.

2. After Payment/commission process

2.1 No refunds will be given once the halfway point of a commission is reached.
If the client wishes to cancel a commission, the refunded amount sent will be calculated based on how much work has been done. The client will also receive the work that has been done up until the refund.

2.2 Revisions:
2.2.1 Unlimited revisions during sketch phase
2.2.2 3 free revisions during flat colour phase
2.2.3 1 free revision during shading phase
2.2.4 No free revision during rendering phase, unless the revision is easily corrected

2.3 Updates will be sent via discord during:
2.3.1 Sketch phase
2.3.2 Flat colour phase
2.3.3 Shading phase
2.3.4 Midway through rendering

2.4 The client cannot under any circumstances force a chargeback once the commission has been agreed upon.

2.5 If the client has inappropriate behaviour, and does not stop after warnings have been issues, I reserve the right to cancel the commission and may not issue a refund. This is entirely at my discretion.

2.6 If personal circumstances prevent me from finishing a commission on time, clients will be informed immediately.

2.7 If the client does not reply for more than a month with no prior notice, I will either:
2.7.1 Refund the commission if commission has only progressed before colouring phase (dependent on complexity)
Client will not receive any artwork if refunded.
2.7.2 Cancel the commission without a refund after sketch phase.
Client will be contacted via Discord and e-mail weekly before this deadline.

3. AFTER THE COMMISSION/RECEIVING THE COMMISSION

3.1 Commissions will be sent to either the client's Discord and e-mail in high-resolution as a PNG. The client will receive:
3.1.1 A high resolution version of the commission, with a minimalist watermark that is not obstructive.
This version is not for sharing publicly anywhere.
This can be used for profile pictures.
3.1.2 A low resolution version of the commission, with a high opacity, minimalistic watermark near the face and/or other detailed areas for sharing publicly.

3.2 The client cannot, under any circumstances, omit my signature/watermark from the commission, including the updates sent during the commission process.

3.3 The artist reserves full rights to the image and its distribution and use, unless otherwise requested (refer to 1.2)
This includes uploading any commissions done on my portfolio and other social media websites, unless it was requested that I do not do so.

3.4 All commissions are personal use only unless otherwise specified. For commercial use, a 100-300% commercial fee will be added to the total commission price.
If the client decides to use a commission commercially after the commission is completed, this can be discussed.
This includes art made by me of character designs and the design themselves.

3.5 For original character design commissions, my original design cannot have any major changes (excluding clothing) without my consent.

3.6 If a client wants me to edit an already commissioned piece made by me, they must consult me and not other artists. The client must not modify or alter the finished piece themselves.

3.7 The client may repost the finished commission (including character design), provided that proper credit is given. This includes sharing new and/or existing art of said design (e.g.: character is designed by fuwahiru)
